SCS SB 197 -- FIRE PROTECTION EQUIPMENT SPONSOR: Johnson (Luetkenhaus) COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Judiciary by a vote of 17 to 0. Under current law, no cause of action exists against fire protection entities for equipment they donate to other entities if the State Fire Marshal approves the equipment. These immunities only apply to actions directly related to this equipment. This substitute requires any motor vehicle that is donated to pass a safety inspection by the State Highway Patrol. Receiving agencies must also demonstrate to the Fire Marshal that any equipment received works properly. Donor agencies must inform the receiving agency in writing of any defect they know about in the equipment. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say that the bill will increase the donation of used fire protection equipment to volunteer fire departments that greatly need equipment, while still providing the volunteer fire departments with some protection. Testifying for the bill were Senator Johnson; and Missouri Fire Service Alliance. OPPONENTS: There was no opposition voiced to the committee.
